Case Problem 4 WORKFORCE SCHEDULING Davis Instruments has two manufacturing plants located in Atlanta, Georgia. Product demand varies considerably from month to month, causing Davis extreme difficulty in workforce scheduling. Recently Davis started hiring temporary workers supplied by WorkForce Unlimited, a company that specializes in providing temporary employees for firms in the greater Atlanta area. WorkForce Unlimited offered to provide temporary employees under three contract options that differ in terms of the length of employment and the cost. The three options are summarized: Option Length of Employment Cost 1 One month $2000 2 Two months $4800 3 Three months $7500 The longer contract periods are more expensive because WorkForce Unlimited experiences greater difficulty finding temporary workers who are willing to commit to longer work assignments. Davis estimates that the cost of training is $875 each time a temporary employee is hired. Thus, if a temporary employee is hired for one month, Davis will incur a training cost of $875, but will incur no additional training cost if the employee is on a two- or three-month contract. Nutrition Food Essay In our today’s society, especially western countries, the issue of fast food seems to be at the top of every health related debate. As these debates become more controversial, the question of who bears the responsibility remains unanswered. In his essay, Don’t Blame the Eater, David Zinczenko attempts to answer this key question by placing the greater responsibility of America’s obesity and other fast food related health issues on the fast food industries. Contrary to Zinczenko’s argument, Raldy Balko, in his essay, What You Eat Is Your Business, states that, people should take ownership of their health and well-being, and are therefore responsible for what and how they eat. Although both Zinczenko and Balko address the issue of responsibility, though with contrast, but valid arguments, Zinczenko seems to present a more convincing argument due to the way in which he explains the politics of food, the way in which our lifestyles are altered by what we eat, and things we can do to change the way we see food and its role in our lives. Although Zinczenko hold consumers responsible to an extent, he blames the fast food industries for the rising rate of obesity and other health issues related to fast food due to their failure to provide labels for their products. Zinczenko convincingly supports his claim by noting statistical data that shows the rise in money spent to treat diabetes. â€Å"Before 1994, diabetes in children was generally caused by a genetic disorder only 5 percent of childhood cases were obesity related, or Type 2 diabetes. Today, according to the National Institutes of Health, Type 2 diabetes accounts for at least 30 percent of all new childhood cases of diabetes in this country†(Zinczenko 392). He argues that, if the fast food companies are regulated so that they are responsible for their food contents, by providing proper labels, than consumers will make informed food choices. Contrary to Zinczenko, Balko argues that what one eats should be a matter of personal responsibility. To Balko’s credit, I believe that people should take personal responsibility for their health by adding a sensible diet and exercise to their routines. Where I differ from Balko is when he says that government restrictions on food are a result of people making poor food choices. According to Balko, â€Å"a society where everyone is responsible for everyone else’s well-being is a society more apt to accept government restrictions† (397). I think Balko’s argument in this regard, is a selfish one, and is an attempt to exempt the rich from paying their fair share of taxes that would otherwise benefit the poor or some middle families who cannot afford the high cost of health insurance. Both Zinczenko and Balko seem to agree on the rising health costs that are somehow a result of fast food, these two authors seem to differ on reasons. Zinczenko argues that health care cost is on the rise because of diseases caused by fast food due to the failure of fast food companies to provide labels and that consumers should not be blame for it. However, Balko argues that it is so that, we allow the â€Å"government to come between us and our waistline† (396). Balko states that, the more the government continues to fund health issues that are direct attribute of poor food/health choices, the more people will continue to dine on fast food and engage not in an effective diet and exercise regimen. (398) The growth of the fast food industry and the rate at which fast food is consumed is so fast, and its accompanying risks of obesity and related cardiovascular diseases have become a societal epidemic. Zinczenko blames the fast food industries for the spring in the rate to which obesity have grown in the United States. Even though Zinczenko is right about the rising rate of obesity, and that the consumption of fast food forms part of its etiology, the thesis of his argument cannot be proven and therefore cannot form the basis for his claims against the fast food companies since there are other contributing factors regarding the cause, onset, and progression of obesity. Obesity is also biologically linked. These biological attributors include: genetics, hormones, enzymes, and vitamins and minerals. Some people have fat in their genes that, no matter what they do, they are just fat. Others have issues with hormonal imbalances and or inadequate enzymatic actions that would aid in the adequate digestion and absorption of certain foods. Fast food is just one of the many environmental attributes associated with obesity. So Zinczenko can accurately make his case against the fast food industries for providing labels so as to enable consumers make informed food choices and not a case of obesity. Sometimes, people are too fast to pass judgment on others, especially people that are obese. I am equally guilty of the accusation myself. I work as a nurse at a nursing home facility and, in most cases, when staff member comes to me complaining of headache, first thing I say to them is; let’s check your blood pressure and, God forbid, the blood pressure is elevated, or if that person just look fat to me, my next comment is, it is because of all the junk you eat. My judgment, though may be incorrect, is based on the fact that most of these staff members are single parents, live in inner cities, and have a total commute time of two hours to and from work. Not to mention, some of them have more than one job. However, these people are being made to feel guilty about something that is totally out their control. In most instances, their wages aren’t even enough to meet up with their rents and utilities bills. Fast food comes handy in such instance where one can spend ten dollars and get ten cheeseburgers to feed a family of three to five versus going to the grocery store where each healthy ingredient is almost equivalent to the price of the entire dinner comprising of fast food. People fall back on fast food because it is cheap. Zinczenko explains that his parents were split up and that he had to live with his mother who worked long hours just to make the monthly bills. â€Å"Lunch and dinner, for me, was a daily choice between McDonald’s, Taco Bell, Kentucky Fried Chicken or Pizza Hut. † (Zinczenko 391). In Zinczenko’s case, his lifestyle is altered because fast food is his only option since his family is dysfunctional. His single mother has to work very hard to pay bills and provide him a meal. It doesn’t matter the kind of meal. A meal is a meal, especially for someone who doesn’t have the time to prepare a home cooked meal. The people afflicted with fast food related obesity are not to blame for what they eat because they have very little or no options regarding what they eat due to all of the above reasons. However, to Balko’s point, while people may not have the option about what they eat, they have the option to control how they eat. Zinczenko states in his essay that fast food is â€Å"the only available options for an American kid to get an affordable meal†, and so, he urges his readers not to â€Å"blame the Eater† (392). But as with Zinczenko, we are well aware of the role fast food play in our lives. We understand that, though fast may be one, or the only available meal choice that we have, the way we eat can help us determine the role these foods play in our lives. Zinczenko supports his argument about the role food play in his life by giving information about his pre-college weight. â€Å"By age 15, I had packed 212 pounds of torpid tallow on my once lanky 5-foot-10 frame† (392). Even Zinczenko believes that, consumers are as equally responsible for the way they eat. However, he maintains his argument that the fast food companies bare the greater responsibility. In conclusion, both the eater and the producer are responsible for fast food related obesity, but I believe that the fast industries should bare the greater responsibility. Fast food companies must provide their consumers with proper food labels that enable them to make inform decision about what they eat. Label should not be falsified or misleading, like in the example giving by Zinczenko about the misleading label on the â€Å"chicken salad† (393). He refers to the salad as not healthy and that it is a caloric death- trap aimed at eaters who will not suspect it. Although Balko makes some really good points, his objectives seem to me as a means to an end. Zinczenko cautions that there are few or no alternatives to what we eat and that things have to change. Balko cautions that allowing food regulations for labels means letting the government between you and your waistline. In either case, we as a people have a responsibility to consider what and how we eat.

Restorative Justice: Process and Outcomes Should restorative justice be defined as a process or a set of outcomes? Restorative Justice rather than relying on judges to sentence offenders, places great emphasis on the importance of reparation and gives a role to the victim of the crime and the wider community. (Newburn, T 2013:768) When it comes to the debate of how restorative justice should be defined, either as a process or a set of outcomes it could be said that while they both have legitimacy, restorative justice can only be defined as one or the other. There is a great disagreement among critics on whether the emphasis should be placed on the outcome or the process. A definition of restorative justice that highlights the importance of both restorative processes and outcomes is, restorative justice is a theory of justice that emphasizes repairing the harm caused or revealed by criminal behaviour. It is best accomplished through cooperative processes that include all stakeholders. (Van Ness and Heetderks Strong, 2006:43) Marshall (1996:37) whos definition is most frequently quoted said that restorative justice is a process whereby parties with a stake in a particular offence come together to resolve collectively how to deal with the aftermath of the offence and its implications for the future. Within this definition 3 core elements of restorative justice are identified. Zehr (2003) stated that the first element is that harm must be healed, restorative justice views crime as harm done to people and communities. It seeks to repair the harm caused by offenders. The second being that violations create obligations, offenders must understand their wrongdoing and restorative justice wants offenders to accept responsibility for their actions. The third element being engagement or participation, relationships are the focus, it is the crime that violates these relationships and restorative justice needs to repair them. The main aim is to mend, restore and build. Dignan (2005, cited in Newburn 2013:771) suggests that Marshalls definition is of very little value for several different reasons, one being it characterises restorative justice as a particular type of process but fails to focus on outcomes, in doing so raises the possibility that undue attention will be paid to questions of equality and fairness. It also fails to consider outcomes by diverting attention away from those cases where restorative justice processes may be inappropriate but where its values and aims may still apply. the process based definition of restorative justice is at best incomplete, because it has nothing to say on the subject of restorative outcomes (Walgrave, 2002:174) this is because there is no direct involvement from the victim needed therefore there is nothing restorative it is just an outcome. Restorative outcomes may include, restitution, reparation and reintegration. It can be argued that a restorative process may not necessarily result in a restorative ou tcome. For example, within restorative conferencing where a direct victim is not present or participating, decisions on outcomes may be left to state regulators. Walgrave argues for an outcome-based definition of restorative justice for example as an option for doing justice in the aftermath of crime that focuses on repairing the harm and suffering caused by the crime rather than preserving an abstract legal order. (Newburn, 2013:772) The victim is seen to be a central stakeholder, who holds an important role in shaping both the process and outcomes of restorative justice. Victims want information about the processing and outcome of their cases, answers to their questions, empowerment and vindication. The process of restorative justice is to meet the needs of crime victims that are not being adequately met by the criminal justice system. Victims may feel ignored or neglected by the justice process. Victims need answers to questions they have about the offense, why has this happened to them? Victims often feel like control has been taken away from them by the offense. Involvement in their own case can be an important way to return a sense of empowerment to them. Restitution by offenders is often important to victims this may come in the form of an apology. (Zehr 2003:18-20). However there are potential dangers when it comes to the victim they may simply become a mere prop used in a process rather than being an empo wered participant. The community is another stakeholder that is considered to be vital to restorative justice. There is a risk of domination, authoritarianism and vigilantism. In N Ireland a restorative justice process was set up in order to stop paramilitary punishments that were being carried out. Braithwaite (1996 as cited in Newburn, 2013) said there are 3 levels at which it is possible to conceptualise the process of restoring community through restorative justice practices. At a micro level it involves those who are close to both the victim and the offender. At a meso level restorative justice helps to foster a sense of community within institutions such as schools, churches and so on. Lastly at a macro level it helps to focus attention on designing institutions of deliberate democracy. Communities need from justice, attention to their concerns as victims. Opportunities to build a sense of community and mutual accountability. Encouragement to take on their obligations for the welfare of their mem bers, including victims and offenders, and for the conditions that promote healthy communities. Community also want assurance of not to repeat the same and preventive actions. (Zehr, 2003:22) The offender is the third stakeholder that is consider to be of value in the restorative justice process. offenders need the opportunity to take responsibility for the harm caused by their behaviour towards victims. Offenders need to take away from the restorative justice process, accountability that addresses the resulting harms, encourages empathy and responsibility, and transforms shame. Encouragement to personal transformation, including healing for the harms that contributed to offending behaviour, opportunities for treatment for addictions and/or other problems, and enhancement of personal competencies. Also encouragement and support for integration into the community (Zehr, 2003:21). Restorative justice aims to help prevent the offender from reoffending again in the future. Being able to face their victims in a restorative justice process provides a chance to also develop empathy and remorse while also having input into the process. Offenders can complete this process threw co mmunity service or by issuing an apology to the victim. Crawford and Newburn (2003, cited in Newburn 2013) stated that in order for there to be a restorative process, stakeholders involved rely on four forms of restorative justice practice. These practices are victim-offender mediation, conferencing, sentencing circles and community boards. In Northern Ireland, diversionary youth conferences are used as a form of restorative justice. As I drive up the hill, passing the mailbox and the meticulously groomed lawn, I find myself taking on a transformation. I breathe a sigh of relief and feel the tension drain from my body in anticipation of seeing "my place." As I turn the corner I see it, to anyone else it just looks like a simple field. But to me, it is my sanctuary that I can escape from the hectic world. This is where I can relax and feel like I’m a kid again. In my field, for a short while time stops, and I don’t have to worry what needs done next. This place also holds many wonderful memories as well as making new ones each year. The field right next to my mom’s house and this is an area where I grew up, living there until I moved off to school. I enjoyed the field by myself just as much as when I was with a group of people. The field sits on the top of a hill and through a clearing in the surrounding woods, farms and other fields offer a panoramic view. In the winter, when the trees are bare of leaves but covered in snow, one can see for miles in any direction. In the summer, the field was the location of the weekly neighborhood baseball series, as well as tackle football with the boys. We spent most of the day running up and down the field and imagining we were the best athletes. The boys would get carried away and take advantage of the girls’ size. They would zero in on the girls and see how hard they could slam them into the ground. There were quite a few times when I was slow to get up because I was hit so hard that it blurred my vision and knocked the wind out of me. When the boys saw my a gony they were amused. They saw this as more incentive to hit even harder. This is one of the many reasons that the girls learned early to fend for themselves. J... ...t to get together, touch base, and catch up with all of the old friends and family. The field is also where I liked to go when I was upset or needed a place to be alone. I went there often in my early teenage years when I was frustrated and needed time to sort out my confusion. It was my own personal, quite place that no one invaded, unlike my bedroom in the house. The field’s view and serenity somehow made me think more clearly and made my problems feel less like the end of the world. This is one of the comforts that I miss from my parents’ house, so when I visit my parents, I visit my place as well. Now when I look back at all of the good times and the peaceful ones also, I feel at ease. I know that every summer at the beginning of July that I will see everyone just the same as last year. And we will create more memories for me to look back at and smile.
